1. Acceptance of Terms

By accessing our website (www.cleverstart.in), utilizing our Digital Business Cards, or subscribing to our enterprise services—including Cloud IVR, Bulk SMS, WhatsApp Business API, Toll-Free 1800 Numbers, Voice Broadcasting, RCS Messaging, SEO, Google & Meta Ads, and Web Development—you agree to be bound by these Terms of Use and all applicable laws and regulations in India.

2. Service Provisions & Eligibility

CLEVER START provides business communications, cloud telephony, and digital marketing tools to registered business entities, professionals, and corporate organizations.

• Users must be at least 18 years of age or authorized representatives of a legally registered business entity.
• Telephony numbers (Virtual Numbers, Toll-Free Numbers, IVR channels) provided by CLEVER START are non-transferable and subject to telecom regulatory guidelines (TRAI & DLT registration in India).

3. User Account & DLT Compliance

Clients utilizing SMS, Voice, and WhatsApp services must maintain account confidentiality and comply strictly with DLT (Distributed Ledger Technology) registration rules specified by TRAI.

• All header IDs, SMS templates, and WhatsApp message templates must be pre-approved under your registered DLT entity.
• You are solely responsible for maintaining the confidentiality of your account credentials and client portal logins.

4. Acceptable Use & Anti-Spam Policy

CLEVER START enforces a strict Zero-Tolerance Anti-Spam Policy. You agree NOT to use our platform to send unsolicited commercial messages, fraudulent calls, phishing content, or unlawful media.

• Sending unsolicited messages to phone numbers registered on National Customer Preference Register (NCPR / DND) without opt-in consent is strictly prohibited.
• Violations will result in immediate service suspension without refund and potential reporting to regulatory authorities.

5. Billing, Payments & Refund Policy

Payment terms for IVR plans, SMS credits, WhatsApp API messaging, and digital marketing services are prepaid unless otherwise specified in a custom enterprise SLA contract.

• Prepaid credits (SMS, Voice, WhatsApp units) have a standard validity period as defined at the time of purchase.
• Refunds are not granted for consumed credits, setup fees, or accounts suspended due to policy violations.

6. Intellectual Property Rights

All brand assets, software code, logos (logo.png), trademarks, and design systems related to CLEVER START are the exclusive intellectual property of Grow Acres Global Ventures Pvt. Ltd. Unauthorized reproduction or modification is strictly prohibited.

7. Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of India. Any legal proceedings or disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.
